I engaged a solicitor as requested by Mum. This is going to cost me money and at this point I don’t think they deserve a price that is any lower than market value now. I had the extraction plant valued in its current condition with full discloser of the fire. By the book, 3 different valuations. 1. A retailer who was selling this very brand of machine. 2. A commercial Beekeeper that has just started using his new machine. 3. A commercial Beekeeper that is waiting for his new machine to be built. They all came back with a value of between $70 000 and $100 000 in it current condition. One even thought that with the current two year waiting time to build a machine, it could fetch as high as $120 000.
So after checking my figures I sent this information to my solicitor on the 9th of December 2021. The solicitor drafted and sent a response on 23rd December 2021.

Dear Mr and Mrs Elson,
1. Extraction plant purchase for $91,000. Current value between $70,000-$100,000
2. Forklift purchased for $5000
3. Box Lifter purchased for $1000
4. Box return roller purchased for $800
5. Wax moulds (agreed value) $75.00
Total of equipment purchased $76,800
Our client’s one-half share totals $38,400.
We are instructed our client is in possession of a Gernie which was also jointly purchased for $1,600.00. It has been agreed that DJ and SK Elson will sell their share to Elson Apiaries Pty Ltd for $800.
We are instructed you are in possession of Wax Moulds. Elson Apiaries Pty ltd accepts your offer of $75.
Total amount owed to Elson Apiaries $37,675. We are instructed that you have already paid the sum of $7,200.00 to our client in part payment of the goods. Therefore, the total outstanding is $30,475.00. Our client understands you may not be in a position to sell the equipment and therefore offers to sell the goods and reimburse you for your half of each piece of equipment as it is sold.
Could you please confirm that you will allow our client access to the property for the purpose of taking photos and obtaining valuations of the equipment.
We are instructed that you have agreed in writing that Elson Apiaries Pty Ltd owns outright the following pieces of equipment currently held on your property:
1. Hot Room valued at $4,000.00;
2. Pallet racking valued at $1,250.00;
3. 3 x 20ft Shipping Containers (not for sale); and
4. 28ft Curtain sider (not for sale).
Other assets owned by Elson Apiaries Pty Ltd which need to be removed from your property.
1. 1800lt Milk Vat. We are instructed you have received an invoice for sale of old honey plant with the 2 Vats. We are further instructed you have received a signed agreement from the purchaser for trade of these Vats to Elson Apiaries Pty ltd.
2. Three phase compressor, clear access for removal will be needed.
3. Hot water system and heat pump in old extraction shed that goes with milk vat.
4. Aluminium Ute tray and trailer parts in tray.
Our client withdraws any permission which may have previously been granted to DJ and SK Elson or anyone else and you are put on notice that you are specifically not permitted to use any assets owned by Elson Apiaries Pty ltd. Any assets that have been used should be stored undercover.
Please confirm you will allow our client access to the property to collect these pieces of equipment within 14 days of the date of this letter.
